These Terms of Service ("Terms") govern your access to and use of the MGM mobile application (the "App") and related services provided by MGM ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 18 years old, have the authority to bind your gym or business to these Terms, and agree to comply with all applicable laws and regulations in India.

2. Description of Service

MGM is a mobile application designed to help gym owners and administrators in India manage clients, memberships, collections, expenses, inquiries, and related gym operations. The App is provided as a mobile-only service and is not a web-based gym management platform.

3. Account Registration

To use the App, you must:

• Register with a valid email address and create a secure password.
• Verify your email address before accessing the App.
• Provide accurate and complete information about yourself and your gym.
• Keep your login credentials confidential and notify us immediately of any unauthorized access.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Upload false, misleading, or fraudulent member or payment data.
• Attempt to gain unauthorized access to the App, its servers, or other users' accounts.
• Reverse engineer, decompile, or disassemble the App.
• Use the App to send spam, malware, or harmful content.
• Resell, sublicense, or redistribute the App without our written permission.

5. Your Data

You retain ownership of the gym and client data you enter into the App. You grant us a limited license to store, process, and display this data solely to provide the service. You are responsible for ensuring you have the right to collect and store member information in accordance with applicable privacy laws.

6. Subscription & Payments

Certain features may require a paid subscription. Pricing, billing cycles, and payment terms will be displayed within the App. Fees are non-refundable except as required by law or as explicitly stated in the App. We reserve the right to change pricing with reasonable notice.

7. Intellectual Property

The App, including its design, code, logos, and content (excluding your data), is owned by MGM and protected by intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or meet your specific requirements. You use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, MGM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms or for any reason with reasonable notice. You may delete your account at any time by contacting us. Upon termination, your right to use the App ceases, and we may delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the App or email. Your continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
